When does a person lack capacity?
According to Section 4 of the Mental Capacity Act, a person lacks capacity in respect to a matter if, at the relevant moment, they are unable to make their own decisions due to a mental or neurological disability or disturbance. Whether the impairment or disturbance is permanent or transient has no bearing.

When is a person unable to make a decision?
Under section 5 of the Mental Capacity Act, a person is considered as someone unable to make a decision for themselves when they are unable to:
- comprehend or understand the information that's relevant to their choice
- retain any knowledge or information relevant to their choice
- use the information or consider it while making a decision
- Communicate the decision clearly based on the above points
